1. Terms of Service
By accessing WHMISWise, a training product owned and operated by ChasTech Inc. (the "Company"), you agree to comply with and be bound by the following terms.
1.1 License to Access
Upon purchase, you are granted a non-exclusive, non-transferable license to view and complete the training materials for individual use. You may not distribute, modify, or resell any portion of the course content without express written consent from ChasTech Inc.
1.2 Compliance & Employer Responsibility
Important Notice: WHMISWise provides "General WHMIS Education" as defined by Health Canada. You acknowledge that completing this course does not constitute full compliance with the Occupational Health and Safety Act (OHSA). Employers are legally required to provide additional site-specific training regarding the particular hazardous products and procedures used in their specific workplace.
1.3 Content Accuracy & "As-Is" Warranty
While we strive to keep our materials current with GHS and WHMIS standards, materials are provided on an "as-is" basis. ChasTech Inc. does not warrant that the training will be error-free or that it will meet every specific regulatory requirement of your unique industry without further consultation of the relevant legislation.
1.4 Limitation of Liability
To the maximum extent permitted by law, ChasTech Inc. and its directors shall not be liable for any indirect, incidental, or consequential damages, including but not limited to personal injury, property damage, or loss of profits arising out of the use or inability to use the training materials. Our total liability shall not exceed the amount paid by you for the specific course license.
1.5 Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts located in the Province of Ontario.
2. Refund Policy
We want you to be confident in your training. Our refund policy is designed to be fair while protecting our digital intellectual property:
- 30-Day Window: Refund requests must be made within 30 days of the original purchase date.
- Eligibility: To be eligible for a refund, the user must not have completed the course and must not have acquired the final WHMIS certificate. Once a certificate has been issued, the product is considered "used" and is non-refundable.
3. Privacy Policy
At ChasTech Inc., accessible via whmiswise.com and chastech.ca, one of our main priorities is the privacy of our visitors. This policy outlines how we handle your data.
3.1 Information We Collect
- Your Name and Email Address for account creation.
- All billing details are processed securely by our PCI-compliant third-party payment processors. ChasTech Inc. does not store or have direct access to your full credit card information.
- Progress and completion data for certification and verification purposes.
3.2 How We Use Your Information
- To operate the training platform and issue verifiable digital certificates.
- To maintain records of training as required for employer compliance audits.
- To communicate regarding your inquiries or account status.
3.3 Log Files
ChasTech follows a standard procedure of using log files to analyze website traffic. This data is not linked to personally identifiable information. Data is managed in accordance with Canadian PIPEDA standards.
